This paper aims to analyze the possibility of establishing atypical criminal sanctions within scope plea agreements. In this context, clash between legality and autonomy will is debated in relation formulation extralegal penalties, reflecting on premise whether or not there a need establish legal rationalization order set limits inherent discretion formalized agreement parties. Finally, after decision-making process, current jurisprudential position proposed conclusion be presented.
